This Disclaimer and Limitation of Liability Policy (“Disclaimer”) is issued by SyannaUI Technologies Private Limited(“Company”, “we”, “us”, or “our”), operator of the NAVOX AI platform, including the website at www.navox.ai (“Platform”).
By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to this Disclaimer in its entirety. This Disclaimer forms part of the legally binding contract between you and the Company and should be read in conjunction with our Terms & Conditions, Privacy Policy, and other applicable policies.
If you do not accept the terms of this Disclaimer, you must immediately cease all use of the Platform.
2. No warranties — as-is service
The Platform is provided strictly on an “as is” and “as available” basis.
To the fullest extent permitted by applicable law, the Company expressly disclaims all warranties, representations, and conditions of any kind, whether express, implied, or statutory, including but not limited to:
- any implied warranty of satisfactory quality, merchantability, or fitness for a particular purpose;
- any warranty that the Platform will meet your specific requirements or expectations;
- any warranty that access to the Platform will be continuous, uninterrupted, timely, or error-free;
- any warranty that defects or errors in the Platform will be corrected;
- any warranty regarding the accuracy, completeness, reliability, or timeliness of any information provided through or in connection with the Platform;
- any warranty that the Platform is free of viruses, malware, or other harmful components.
No oral or written information provided by the Company or any of its agents, officers, directors, or employees shall create any warranty not expressly stated in this Disclaimer or in the Terms and Conditions.
3. Disclaimer regarding security
While NAVOX AI employs industry-standard safeguards designed to protect data in transit and at rest, the Company makes no absolute guarantee that:
- the Platform will prevent all unauthorised access, particularly where your device or browser has been compromised, infected with malware, or configured insecurely;
- security measures will be effective against all present or future threats, including sophisticated or state-level adversaries;
- information you submit through the Platform will remain confidential in all circumstances or jurisdictions.
The security of your use of the Platform depends upon your own device, browser, and network security. The Company is not responsible for security failures attributable to your equipment, third-party networks, or services outside our reasonable control.
4. Disclaimer regarding flight fares, availability, and booking
NAVOX AI is a flight fare discovery and comparison tool. The Company makes the following express disclaimers:
- displayed fares, schedules, routes, and availability are snapshots sourced from third-party data providers and may be incomplete, delayed, outdated, or incorrect by the time you view or act on them;
- the Company does not sell airline tickets, operate flights, or act as your travel agent. Any booking is solely between you and the airline or travel seller you choose;
- prices shown in chat, search results, or calendar views are indicative only. Final price, baggage rules, fare conditions, and seat availability are determined at checkout on the booking provider’s site;
- you are solely responsible for verifying all travel details — including dates, airports, passenger names, visas, and health requirements — before completing a purchase.
The Company shall not be liable for any loss arising from fare changes, booking errors, missed flights, denied boarding, or disputes with airlines or travel sellers.
5. Disclaimer regarding AI-assisted content and search results
The Platform uses artificial intelligence and automated tools to interpret your requests, suggest airports, format search parameters, and rank results. Accordingly:
- AI-generated suggestions, summaries, and interpretations may be inaccurate, incomplete, or unsuitable for your circumstances;
- the Company does not endorse, verify, or guarantee the accuracy of AI outputs or third-party fare data displayed through the Platform;
- you are solely responsible for reviewing search parameters and results before relying on them for travel decisions;
- the Company is not liable for any loss, damage, harm, or legal liability arising from your reliance on AI-assisted content or automated search results.
6. Disclaimer regarding future features and roadmap
The Company may from time to time describe planned or anticipated features, including integration with additional payment options, itinerary tools, loyalty programmes, or enhanced AI capabilities. All such descriptions are provided for informational purposes only and do not constitute a commitment, promise, or warranty that:
- any planned feature will be developed or released;
- any planned feature will be released within any particular timeframe;
- any planned feature will perform in the manner described.
The Company reserves the right to change, delay, cancel, or modify its product roadmap at any time without notice or liability.
7. Disclaimer regarding third-party services
The Platform relies on and may link to third-party services, including travel data providers, airlines, booking sites, analytics tools, and AI model providers. The Company makes no representations or warranties about third-party services and accepts no responsibility for:
- the availability, reliability, accuracy, or performance of any third-party service;
- the privacy, security, or data practices of any third party;
- any loss or damage arising from your interaction with a third-party website, app, or seller.
8. Limitation of liability
This section contains important limitations on the Company’s liability. Please read it carefully.
8.1 Exclusion of consequential loss
To the maximum extent permitted by applicable law, the Company and its directors, officers, employees, agents, affiliates, licensors, and service providers shall not be liable for any:
- indirect, incidental, special, consequential, exemplary, or punitive damages;
- loss of profits, revenue, business, data, goodwill, or anticipated savings;
- loss of or damage to reputation;
- loss arising from business interruption;
- loss arising from the use of, inability to use, or unauthorised access to, the Platform,
even if the Company has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
8.2 Cap on aggregate liability
The Company’s total aggregate liability to you for all claims arising out of or in connection with the Platform, this Disclaimer, or the Terms and Conditions, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed:
- the total amount paid by you to the Company in the twelve (12) months preceding the event giving rise to the claim; or
- INR 1,000 (Rupees One Thousand Only), where you have not made any payment to the Company.
8.3 Saving provision
Nothing in this Disclaimer shall operate to exclude or limit liability for: (a) death or personal injury caused by the Company’s negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot lawfully be excluded or limited under applicable law; or (d) rights that mandatory consumer protection law in your jurisdiction does not permit to be excluded.
9. Consumer rights
If you are a consumer, nothing in this Disclaimer affects your statutory rights under applicable consumer protection legislation. In India, your rights under the Consumer Protection Act, 2019 are not affected by this Disclaimer. In the European Union and United Kingdom, your rights under applicable consumer protection law are not affected. We do not attempt to exclude or limit any right that cannot be excluded by law.
10. Governing law and severability
This Disclaimer is governed by the laws of the Republic of India. If any provision of this Disclaimer is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.
